Realtour
AI disclosure rules for listing photos and video
Realtour labels every AI edited photo, keeps the original, and publishes a disclosure page with a QR code for each run. The rules below are the ones that shape that, as we read them on 2026-10-27. They change, and every MLS board writes its own: confirm your board's rule before you publish, and tell us when one moves.
California
Business and Professions Code section 10140.8 (AB 723, in force 2026)
An AI altered image of a property in marketing must be disclosed as altered, and the unaltered original must be available to the viewer (a link or a QR code on the material is the accepted form). Virtually staged images carry a staging statement.

Wisconsin
2025 Wisconsin Act 69
A digitally altered image of a residential property in an advertisement must carry a clear and conspicuous disclosure that it was altered, and the unaltered image must be provided to a buyer on request.

Texas
Texas Real Estate Commission rules on advertising (22 TAC 535.155) and MLS rules
Advertising may not be misleading; a virtually staged or otherwise altered image must be labeled so a reasonable person is not misled about the property's condition. Most Texas MLS boards require the words Virtually Staged on the image.

New York
Department of State guidance on misleading advertising (19 NYCRR 175.25) and MLS rules
An image that does not depict the property as it is must be labeled as virtually staged or edited, and the actual condition must not be misrepresented. Boards such as OneKey MLS require the label on the image itself.

MLS boards in general
The board's own photo and video rules
Most boards accept a silent video with no text, no logos and no agent branding as the listing video, and require AI edited photos to be labeled on the image. The exact words differ by board: check yours before you upload.

What Realtour does on every run
- Every edited photo keeps its original and gets a copy with an AI label burned into the corner.
- The MLS cut is silent, carries no text and shows the AI label on every frame.
- A public page per run shows each edited photo beside its original with the edit named, with a short link and a QR code for print.
- A package (zip) holds the originals, the labeled copies and a note per photo naming the edit and the date.
- The caption line we draft says when photos were virtually staged and that the video is AI animated.
This page is a plain index, not legal advice. Tell us when a rule changes and we will update the date.
