Terms of Service

By creating an account or using nolgia.com, the Nolgia API, CLI, or MCP server (together, the "Service"), you agree to these Terms of Service and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

You must sign in with a valid Google account and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at nolgiaai@gmail.com if you suspect unauthorized access.

Paid plans are billed through Stripe on a recurring monthly or yearly basis. Each plan grants a monthly credit allowance; top-up credit packs may be purchased separately.

Subscription credits reset each billing cycle and do not roll over. Top-up credits persist until consumed.

You may cancel at any time from the billing portal; access continues until the end of the paid period. Except where required by law, payments are non-refundable.

We may change pricing with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance.

You agree not to use the Service to: violate any law; infringe intellectual-property or privacy rights; generate content that is sexually exploitative of minors, or that constitutes harassment, incitement to violence, or fraud; attempt to bypass credit metering, rate limits, or plan gating; probe or disrupt our infrastructure; or resell raw access to the Service without a written agreement.

We may suspend or terminate accounts that violate these rules, with or without notice, and forfeit remaining credits where the violation is willful.

You retain ownership of the prompts and reference assets you submit. Subject to your plan and these terms, Nolgia assigns to you all right, title, and interest it holds in the outputs you generate, to the extent permitted by applicable law and upstream model provider terms.

You grant Nolgia a limited license to host, process, and transmit your inputs and outputs solely to operate the Service.

You are responsible for ensuring your inputs and your use of outputs comply with applicable law and third-party rights.

Generation is fulfilled by third-party foundation models. Provider availability, capability, and pricing may change, and individual models may be added, modified, or retired without notice. Output quality is inherently probabilistic and not guaranteed.

The Service, including its software, design, and branding, is owned by Nolgia Corp and protected by intellectual-property laws. These terms grant you no rights to our trademarks or brand assets.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOLGIA CORP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access for violation of these terms, extended non-payment, or if required by law. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) survive.

We may update these terms from time to time. We will post the revised version here and update the date above; material changes will be announced in the app or by email. Continued use after changes take effect constitutes acceptance.
